Arguing for the existence of an arbitration agreement is the means granted by the positive laws of the stakeholder from the arbitration agreement. For the actions of the force binding on this agreement and to achieve its negative effect of refraining from bringing the agreed dispute on arbitration to the judiciary and preventing the state judiciary from adjudicating this dispute, when one of the parties to the arbitration agreement violates the binding force of this agreement and submits the dispute to the national judiciary
